eligibility

You must be at least 16 years old to use the app. If you are under 18, you represent that a parent or legal guardian is aware of your use of the app and accepts these terms on your behalf.

your account

You are responsible for keeping your login credentials secure and for all activity under your account. You agree to provide accurate information during signup. One person may not maintain multiple accounts to evade enforcement of these terms.

your content

You retain ownership of the videos, images, comments, and other content you post ("user content"). By posting user content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, transmit, and display that content as needed to operate the app. This license ends when you delete the content or your account, except for copies already created by sub-processors and any cached copies in transit on the CDN, which are removed in the ordinary course of operations.

You represent that you own or have all necessary rights to post the content you upload, that it does not infringe any third party's intellectual-property or privacy rights, and that it complies with these terms.

acceptable use

You agree not to:

— Post content that is unlawful, hateful, sexually explicit, violent, harassing, or that exploits minors.

— Post content you do not own or have proper license or permission to share.

— Impersonate another person or misrepresent your affiliation with anyone.

— Harvest, scrape, or otherwise programmatically collect data from the app.

— Attempt to inflate engagement metrics, evade rate limits, or interfere with the app's normal operation.

— Use the app to send spam, phishing, or malicious links.

data usage

The app streams and uploads video content which may consume significant amounts of mobile data. You are solely responsible for all data charges, overage fees, and costs imposed by your mobile carrier or internet service provider in connection with your use of the app. We recommend connecting to Wi-Fi when uploading or streaming videos.

reporting and moderation

We may remove any content and suspend or terminate any account at our discretion, with or without notice, for any violation of these terms or for any reason we believe is necessary to protect users or the integrity of the app. We are not obligated to monitor all user content but may do so.

ending your account

You can delete your account at any time from profile settings. Once deletion is confirmed, your account, content, and derived data are removed as described in our privacy policy. Deletion is permanent and cannot be reversed.

We may end your access to the app for any of the reasons listed above. If we do, the licenses you granted us in your user content end at the same time as deletion above.

disclaimers

The app is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or secure, or that any content posted by other users is accurate or appropriate.

limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of the app.

hold harmless and indemnification

You agree to indemnify, defend, and hold harmless Behold Beauty and its owners, officers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the app; (b) content you post or upload; (c) your violation of these terms; or (d) your violation of any third party's rights, including intellectual-property or privacy rights.

apple as third-party beneficiary

You acknowledge and agree that Apple, Inc. and its subsidiaries are third-party beneficiaries of these terms of service, and that upon your acceptance of these terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these terms against you as a third-party beneficiary thereof.

changes to these terms

We may update these terms. Material changes will be communicated in the app. Continued use after a change constitutes acceptance.
